Terms of Service

You may use the site to learn about the property and to make or enquire about a booking. You may not use it in any way that is unlawful, that damages or overloads it, or that interferes with anyone else's use of it, and you may not attempt to access the administration area or any part of the site you are not authorised to use.

All text, photographs, video, the logo and the design of this site belong to The Spot or are used with permission. You may not copy, reproduce or use them without our written consent, other than viewing the site in your browser and sharing links to it.

The Spot offers one villa in two units, which can be booked as a single unit or as the entire villa; three casitas; and the entire property. Bookings are made either directly through the Lodgify booking widgets on this site or through Airbnb, Booking.com or Vrbo. A booking is confirmed only when the platform you used confirms it and payment has been taken under that platform's terms.

When you book through a platform, that platform's terms, payment rules and cancellation policy apply to the transaction, alongside these terms for your use of the property. Where the two conflict on payment or cancellation, the platform's terms prevail. Bookings of the entire villa or the entire property that are arranged over WhatsApp are confirmed in writing by us and are subject to the payment and cancellation terms stated in that confirmation.

Prices are shown in US dollars per night, may change until a booking is confirmed, and exclude anything not expressly listed. Rates on the platforms may differ from those shown here because of platform fees; the rate you accept on the platform at the time of booking is the one that applies.

Each villa unit sleeps 4 to 6 people comfortably and a maximum of 10 using the futons; the entire villa a maximum of 20; each casita a maximum of 2; the entire property a maximum of 26 overnight guests. The number of guests must not exceed what you booked. Additional guests, day visitors and events are only allowed with our prior written agreement.

Pets are not allowed. Smoking is not allowed indoors. Quiet hours run from 10 pm to 7 am out of respect for other guests and neighbours. The person who makes the booking must be at least 18 years old and is responsible for the conduct of every guest in the party.

Check-in and check-out times, access instructions and any further house rules are provided with your booking confirmation and form part of these terms.

When a single villa unit is booked, the other unit and the casitas may be occupied by other guests, and the pool, deck and grounds are shared. Exclusive use of the property is only guaranteed when the entire property is booked.

The pool, the casita jacuzzis and the grounds are used at your own risk. There is no lifeguard. Children must be supervised by an adult at all times near water. Guests must not use the pool or a jacuzzi while intoxicated, and must follow any safety instructions we provide. The property is in a tropical setting with wildlife, uneven ground and natural hazards; please take reasonable care.

You are responsible for any damage to the property or its contents caused by you or your guests beyond normal wear and tear, and for the cost of repair or replacement. We may end a stay early, without refund, if guests break these rules, endanger others, or cause serious disturbance.

Events and retreats are arranged individually and require the entire property or our prior written agreement. Where we help you plan an itinerary or arrange transport, chefs, equipment or activities, we act as an introducer: you contract with and pay those providers directly unless we confirm otherwise in writing, and they are responsible for the services they deliver.

Cancellations and date changes for platform bookings follow the cancellation policy shown on the listing at the time you booked. For direct bookings confirmed over WhatsApp, the cancellation terms are those stated in your confirmation. We may cancel a booking if the property becomes unavailable for reasons outside our control (for example severe weather, natural events, utility failure or government order); in that case we will refund what you paid us and we will not be liable for any further loss.

To the fullest extent permitted by law, The Spot is not liable for loss of or damage to your belongings, for personal injury or illness other than that caused by our negligence, for travel disruption, or for indirect or consequential losses. Nothing in these terms limits liability that cannot be limited under applicable law. We recommend that you hold travel insurance covering your stay.

The site is provided as is. We try to keep its content accurate, but photographs are illustrative and availability and prices are those confirmed at booking. Links to third-party sites and platforms are provided for convenience; we are not responsible for their content or practices.

How we handle personal data is explained in our Privacy Policy, which forms part of these terms.

These terms and any stay at The Spot are governed by the laws of the Republic of Costa Rica. Any dispute that we cannot resolve together is subject to the courts of Limón, Costa Rica, without prejudice to any mandatory consumer protections that apply where you live. Where a booking was made through a platform, that platform's dispute process applies to the transaction itself.

We may update these terms from time to time; the date at the top shows when they last changed. The terms in force when you made your booking apply to that booking.
